====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 At the outset, learned counsel for the petitioner prays for and is allowed to make necessary corrections in paragraph 1 of the petition.
2. Permission is accorded.
3. Heard learned counsel for the petitioner and learned A.P.P. for the State.
4. The petitioner seeks bail in a case registered for offences punishable under Sections 191(2), 191(3), 190, 329(3), 126(2), 115(2), 103(2), 351(2), and 352 of the B.N.S., 2023.
5. As per the prosecution case, the informant alleged that on 03.09.2024, all the FIR-named accused, including the petitioner, with common intention, came to his doorstep and brutally assaulted the informant's side with lathi, danda, and hockey sticks, and during the course of treatment, the informant's son died.

6. Learned counsel for the petitioner submits that the specific accusation of assault is against Raj Kumar Ram and Anup Ram. There is only general and omnibus allegation against this petitioner. Co-accused Shakuntala Devi, having similar and identical allegations, has already been granted bail by this Court vide order dated 17.09.2025 passed in Cr. Misc. No. 64757 of 2025. The petitioner is in custody since 19.07.2025 and the charge-sheet has been submitted in this case.
7. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
8. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
9. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Ramnagar P.S. Case No. 22 of 2025.
