JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is in custody since 15.10.2019, seeks bail in connection with Ghosi (Okari O.P.) P.S. Case No. 367 of 2019, dated 14.10.2019, instituted for the offences under Sections 341, 323, 354(B) of the Indian Penal Code and Section 8 of Prevention of Children from Sexual Offences (POCSO) Act.

From the accusation levelled in the First Information Report, it appears that the petitioner is a jilted lover. He is alleged to have made attempts of dragging the prosecutrix out of a bus and taking her on his vehicle but because of timely intervention of others, the mishap could be averted.

Patna High Court CR. MISC. No.78646 of 2019(3) dt.17-03-2020 2/2 Learned counsel for the petitioner submits that from the reading of the First Information Report it would appear that the prosecutrix was known to the petitioner from before because both of them studied in one coaching centre.

However, taking into account the age of the petitioner and the period of custody, petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 1st, Jehanabad in connection with Ghosi (Okari O.P.) P.S. Case No. 367 of 2019.

The application stands allowed.
