2. Petitioner seeks regular bail in connection with Kopa P. S. Case No. 63 of 2023 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506 of the Indian Penal Code and subsequently, Section 302 of the Indian Penal Code has been added.
3. As per the prosecution case, this petitioner inflicted knife blow as a result of which the informant and three other persons sustained sharp cut weapon injuries. It is further alleged that one of the injured namely, Jitendra Rai, died during the course of treatment.
4. Learned counsel for the petitioner submits that due to land dispute, an altercation took place between the parties in
Patna High Court CR. MISC. No.86515 of 2023(3) dt.21-03-2024 2/2 which both sides sustained injuries. Case and counter case. Petitioner is in custody since 20.04.2023.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that there is specific accusation against the petitioner that he assaulted the informant and others with knife as a result of which one Jitendra Rai succumbed to the injury.
6. Considering the aforesaid facts and circumstances of the case and nature of accusation, prayer for bail of the petitioner is rejected.
