2. The petitioner apprehends his arrest for the offence alleged under Sections 341, 323, 307, 379, 504, 506 and 34 Indian Penal Code registered in connection with Sahpur P.S. Case No. 266/2018.
3. It is submitted that the petitioner has been falsely implicated over a petty dispute and there is case and counter case between the parties. The injury sustained by the informant is simple in nature (Annexure-2).
4. Learned A.P.P invites reference to the injury report of the case diary, according to which X-ray of skull shows crack of occipital area, subject to the confirmation by C.T. scan.
5. Having regard to nature of the allegations and
Patna High Court CR. MISC. No.75795 of 2018(3) dt.14-03-2019 2/2 gravity of offences alleged as well as the injury report showing crack of occipital area, this court is not inclined to grant the privilege of anticipatory bail to the petitioner. The anticipatory bail petition stands dismissed.
6. If the petitioner surrenders and seeks regular bail before the learned court below the same shall be considered on its own merit in accordance with law and shall be disposed of expeditiously without being prejudiced by any observation in the present order.
