2. The petitioner seeks bail in connection with Gurua P.S. Case No. 57 of 2025 dated 11.02.2025 registered for the offence punishable under Section 8(b) and 20(a)(i) of the N.D.P.S. Act.

3. The allegation against the petitioner and one Sudama Singh is that they cultivated ganja plant in the premises of their joint house. The police party recovered 20 kg ganja from the premises of joint house of co-accused Sudama Singh and the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that nothing has been recovered

Patna High Court CR. MISC. No.84334 of 2025(2) dt.23-12-2025 2/2 from the conscious possession of the petitioner and he is in no way connected with the aforesaid recovery. It is further submitted that the petitioner has been made accused only on the basis of suspicion. It is also submitted that recovery of ganja like substances is less than commercial quantity. Lastly, it has been submitted that the petitioner is in custody since 28.07.2025, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Gayaji in connection with Gurua P.S. Case No. 57 of 2025.
