JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks bail in connection with Kasimbazar P.S.Case No. 186 of 2018 registered under Sections 302 of the Indian penal Code and 27 of the Arms Act.
Allegation against the petitioner is that in conspiracy with other accused persons killed the deceased and specific allegation is against Rajiv Kumar who had fired at Jai Ram Kumar which hit him on temporal region and died in hospital . Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and he is in custody since 23.09.2018 having no criminal antecedent and other co-accused persons, having similar allegation, have been granted bail by a co-ordinate Bench of this Court vide order dated 06.12.2018 passed in Cr. Misc. No. 72490 of 2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kasimbazar P.S. Case No. 186 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
