JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

Petitioner is not named in the first information report and it appears that the name of this petitioner came in confessional statement of co-accused in course of investigation. Learned counsel appearing for the petitioner submits that the name of the petitioner came in confessional statement of co-accused, namely, Pramod Kewat @ Rahul Kewat @ Pramod Kumar @ Rahul Kumar and the aforesaid co-accused has already been granted privilege of bail by a co-ordinate Bench of

Patna High Court Cr.Misc. No.199 of 2019(2) dt.17-01-2019 2/2 this Court vide order dated 30.01.2018 passed in Cr. Misc. No. 5099 of 2018.

Moreover, petitioner appears to be in jail custody since 23.4.2018 and the investigation against him has already been completed. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna City in connection with Gaurichak P.S.
