JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-09-2023 Heard learned senior counsel for the petitioner and learned counsel for the Lalit Narayan Mishra Institute of Economic Development and Social Change, Patna (hereinafter referred to as the 'Institute').

2. It is an admitted position that the petitioner is still continuing as Adjunct Faculty Member and is being paid on class to class basis.

3. Learned counsel for the Institute submits that very soon an advertisement is coming for regular appointment of the teachers and in case the petitioner fulfills the eligibility

Patna High Court CWJC No.23378 of 2018(7) dt.11-09-2023 2/2 conditions, she may also be considered along with others.

4. Having regard to the aforesaid submission made on behalf of the learned counsel for the Institute, learned senior counsel for the petitioner submits that in such circumstance nothing remains for adjudication at present stage.

5. This writ application is being disposed of taking note of the submission of learned counsel for the Institute that in terms of advertisement which is likely to come if the petitioner is found eligible, she would also be considered.

6. Learned senior counsel for the petitioner has submitted that, in the meantime, the petitioner should not be replaced by any other adhoc engagement.

7. This Court is of the considered opinion that unless there is any other plausible reason the petitioner need not be disturbed/disengaged only to replace her with any other adhoc engagement.

This writ application stands disposed of accordingly.
