JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Surjgarha P. S. Case No.256 of 2018 registered for the offences punishable under Sections 420, 468 and 409 of IPC. As per prosecution case, there is allegation that the payment has been made to 50 farmers with respect to purchase of 3770 quintals of paddy and it appears that by opening a single form, the amount has not been paid to the different farmers, but same has been misappropriated. As such, a case has been lodged by co-accused Rajeev Singh, EX. Manager, against one Ram Snehi Singh regarding the misappropriation of the amount. Further submission is that he is in custody since 26.08.2019. He is ready to co-operate in disposal of the trial.

Heard learned A.P.P. as well as counsel appearing for the Bank has opposed the prayer for bail.

Having heard both sides, in view of the submissions, made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Lakhisarai, in connection with Surjgarha P. S. Case No.256 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
