2. Petitioner seeks bail, who is in custody since 23.12.2020, in connection with Jahanabad Mahila P.S. Case No. 38 of 2020, F.I.R. dated 01.11.2020 registered for the offences punishable under Sections 342, 506, 354(B), 354(C ), 376(D), 384, 34 of the Indian Penal Code and Sections 4/6 of the POCSO Act.
3. Earlier the bail petition of the petitioner was rejected vide order dated 16.02.2022 passed in Cr. Misc. No. 36146 of 2021 and thereafter the petitioner has again moved before this Court in Cr. Misc. No. 62676 of 2023 which was withdrawn with liberty to the petitioner to move afresh before the learned Trial Court and pursuant to the direction, the
Patna High Court CR. MISC. No.941 of 2024(2) dt.19-01-2024 2/2 petitioner had moved before the learned Trial Court and the bail petition of the petitioner was rejected on 18.10.2023.
4. From perusal of the impugned order, it transpires that the evidence of all the P.Ws. have been recorded and now the case is stage of defence witness.
5. In view of the aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Jahanabd Mahila P.S. Case No. 38 of 2020 pending in the Court of A.D.J. VI POCSO, Special Judge, Jahanabad.
6. Prayer is refused.
7. However, learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U
