2. The petitioner has preferred this application for grant of regular bail in connection with Banjaria P.S. Case No. 183 of 2024 dated 26.07.2024 registered for the offences punishable u/ss 190, 191(2),(3), 109, 118(1), 74, 303(2) and 352 of the B.N.S., 2023.

3. As per the prosecution case, the petitioner is alleged to have assaulted the informant's son with bhala due to which he sustained injury in his left eye.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a case and counter case between the parties.

Patna High Court CR. MISC. No.89337 of 2024(2) dt.08-01-2025 2/2 Nothing has been recovered from the conscious possession of the petitioner. As per the injury report of Sahnawaj Alam, two injuries were found on the body of the injured and the injuries are simple in nature caused by hard and blunt substance. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Banjaria P.S. Case No. 183 of 2024.

7. The application stands allowed.
