JUSTICE SHIVAJI PANDEY ORAL ORDER 28-05-2020 Heard learned counsel for the petitioners and learned counsel for the State through virtual court proceeding. In this case, the petitioners are seeking bail in connection with Teghra P.S. Case No. 311 of 2019 registered for offences under sections 414, 120(B), 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that the S.H.O. of Teghra Police Station, on receipt of secret information, intercepted a motorcycle and an Alto car near the tractor. On seeing the police party, they tried to flee away from there but, a lady was apprehended by the police who disclosed that the petitioners are

Patna High Court CR. MISC. No.78297 of 2019(6) dt.28-05-2020 2/2 also involved in illegal trade of liquor, whereafter, both the petitioners were arrested by the police. The police has recovered altogether 236.280 liters foreign liquor from the tractor, Alto car as well as from the motorcycle.

The petitioners are in judicial custody since 01.11.2019.

Looking to the entire facts and circumstances of the case as also considering the present situation arising out of Covid-19 outbreak, let the petitioners, above named, be released on bail on furnishing personal bail bond to the satisfaction of learned Additional Sessions Judge II, Begusarai cum Special Judge, Bihar Prohibition and Excise Act, 2016, Begusarai in connection with Teghra P.S. Case No. 311 of 2019, subject to the condition that if the petitioners are found involved in future in similar type of offenses, the prosecution will be at liberty to make prayer for cancellation of their bail and the court below will pass necessary order, including cancellation of bail granted to the petitioners.
