====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-01-2019 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Supaul Police Station Case No. 508 of 2018, disclosing offences under Sections 198, 420, 467, 468, 471, 477A and 120B of the Indian Penal Code.

The petitioner is said to have obtained appointment as Panchayat Teacher on the basis of her certificates, which have been found to be forged.

Learned Counsel for the petitioner has submitted that her services has been terminated. He has also submitted that the documents, which she has submitted, were not forged. Considering the above submission and the fact that

Patna High Court Cr.Misc. No.75937 of 2018(3) dt.09-01-2019 2/2 allegation against the petitioner is based on documents and there is no likelihood of tampering with the evidence, this application is allowed.

Let the petitioner, Hira Kumari, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul Police Station Case No. 508 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
