The petitioner seeks regular bail in connection with Chhatapur PS case no. 156 of 2018 instituted for the offence punishable under Sections 379/34 of Indian Penal Code. The allegation is regarding unknown miscreants having intercepted the informant and snatched one bag and various articles from him.

The learned counsel for the petitioner has submitted that the petitioner is innocent and his name has transpired during the confessional statement made by the co-accused person namely Rupesh Kumar Bahradar and the said Rupesh Kumar Bahradar has already been granted bail by a co-ordinate Bench of this Court vide order dated 20.09.2018

Patna High Court CR. MISC. No.78656 of 2019(2) dt.03-12-2019 2/2 passed in Cr. Misc. no. 51812 of 2018. It is further submitted that neither any recovery has been made from the petitioner as far as the stolen articles are concerned nor any T.I.P. has been held so as to implicate the petitioner in the present case. It is further submitted that some other co-accused persons have already been granted the privilege of regular bail vide orders dated 25.09.2018, 26.09.2018 and 04.02.2019 passed in Cr. Misc. no. 51486 of 2018, 51531 of 2018 and 4046 of 2019 respectively.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Supaul in connection with Chhatapur PS case no. 156 of 2018.
