The petitioners are apprehending their arrest in a case registered under Sections 341, 342, 323, 448, 307, 354, 379, 504, 506 of the Indian Penal Code.

The prosecution case, in brief, is that while the husband of the informant was sitting in his courtyard, the accused persons variously armed, entered into the courtyard and started abusing. On protest the husband of the informant was assaulted. The accused persons are alleged to destroy the articles and commit loot.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court Cr.Misc. No.76256 of 2018(2) dt.18-12-2018 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. Though allegations are specific in nature but the matter has already been compromised between the parties vide Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case No. 82 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
