====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2025 Heard learned counsel for the parties.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 302/34 of the IPC.
3. Informant's daughter was married with co-accused Gato Lal Deo about 10 years back. After sometime, petitioners and their family members started subjecting the victim to cruelty and harassment for non-fulfilment of demand of dowry. On 22.4.2024 informant got information that these accused persons assaulted and administered poison to her daughter causing her death.
4. Learned counsel for the petitioners submits that the petitioners are in-laws of the deceased and there is general and omnibus allegation against them and no specific overt act has

Informant herself filed a petition dated 11.2.2025 before the cout of Additional Chief Judicial Magistrate I, Darbhanga stating therein that her daughter died during treatment and her husband and in-laws are quite innocent. Similarly situated co-accused, who is husband of deceased, has has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 18.6.2025. no.1 and 2 are mother-in-law and father-in-law of the deceased, whereas petitioner no.3 is married nanad of the deceased. There is general and omnibus allegation against these petitioners and no specific overt act has been alleged against them. They are separate in mess and business. Thrust of allegation is against the husband of the deceased who is in custody.
5. Learned counsel for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let both the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 9, Darbhanga in
