====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 24-12-2025 Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.
2. The petitioner apprehends his arrest in connection with Taraiyan P.S. Case No. 199 of 2023, registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.

Allegedly on the fateful day while the petitioner was returning to his home after attending the marriage, in the meanwhile, he was surrounded by the accused persons and started abusing and assaulting him by butt of the pistol. It is specifically alleged that one Sonu Singh assaulted him by means of butt of the pistol over his nose, whereupon, the petitioner alongwith others gave iron rod blow over the body, due to which
Patna High Court CR. MISC. No.85323 of 2025(2) dt.24-12-2025 2/3 he also sustained injuries. There is further allegation of snatching of rupees seventy thousand cash and other valuables of the informant which he had kept after collecting from different shop-keepers.
4. Learned Advocate appearing on behalf of the petitioner submitted that with respect to an occurrence which took place on 17.06.2023, the present FIR came to be instituted on 21.06.2023. Moreover, the specific accusation is levelled against co-accused Sonu Singh, who has been accorded the privilege of anticipatory bail by a Bench of this Court in Criminal Miscellaneous No. 5812 of 2024 vide order dated 22.02.2024, the copy of which is marked as Annexure P/2 to the bail application. The petitioner has absolutely fair antecedent and he undertakes that he will fully cooperate in the proceeding of the Court.
5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioner has actively participated in the crime and brutally assaulted the informant.
6. Having considered the submissions set forth by learned Advocate for the respective parties and taking note of the fact that the case of the petitioner is based on parity with that of co-accused person who has been accorded the privilege of

No.85323 of 2025(2) dt.24-12-2025 3/3 anticipatory bail, besides the delay in lodging of the FIR as well as the fair antecedent of the petitioner, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Saran at Chapra in connection with Taraiya P.S. Case No. 199 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
