2. The petitioners are seeking regular bail in connection with Jankinagar P.S. Case No. 366 of 2024, registered for the offences punishable under Sections 25(1B)a/26/35,25(1-AA) of the Arms Act.
3. As per the allegation, on 12.10.2024, the informant
Patna High Court CR. MISC. No.88338 of 2024(2) dt.05-02-2025 2/2 reached at village Vinobaragram along with police. At that time, having seen arrival of the police, 2 persons tried to flee away but both were chased and apprehended. However, upon investigation, it was found that they along with their gang were involved in selling of illegal arms.
4. The learned counsel for the petitioners has submitted that nothing was recovered from possession of the petitioners. On the basis of their confessional statements, a country-made pistol was recovered from a bush. The petitioners are under custody since 13.10.2024.
5. Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sesions Judge-VI-cum Special Judge POCSO, East Champaran at Motihari in connection with Jankinagar P.S. Case No. 366 of 2024, subject to the following condition the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
