The petitioner apprehends his arrest in connection with Buniyadganj P.S. Case No. 65 of 2019 for the offence registered under Sections 341, 323, 384, 385, 427, 504, 506 and 34 of the Indian Penal Code.

The allegation is regarding the co-accused persons, namely, Md. Ahmad, Md. Irshad, Md. Aslam and Md. Rahmat having arrived at the plot of the informant and had started asking for extortion money and upon their refusal they started abusing the informant and had also called the petitioner and other co-accused persons on telephone whereafter the petitioner and other co-accused persons had arrived there and they

Patna High Court CR. MISC. No.79574 of 2019(2) dt.04-12-2019 2/2 engaged in assault upon the informant and his family members. The learned counsel for the petitioner submits that the petitioner is innocent, he is having a clean antecedent and he has been falsely implicated in the present case. It is further submitted that the main accused person has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 18.10.2019 passed in Criminal Misc. No. 64092 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya in connection with Buniyadganj P.S. Case No. 65 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
