JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2020 The petitioner who is in custody since 24.10.2019 seeks bail in connection with Simra P.S. Case No. 44 of 2019 instituted for the offences under Sections 2(5), 3, 2(40), VIII of the Bihar Mahua Flower Act, 2006 and Section 30(c) of the Bihar Prohibition & Excise Act, 2016.

It is alleged that 320 Kgs of mahua flower was recovered from a vehicle which was being driven by the petitioner.

The learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case and the recovery has wrongly been saddled on

Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Simra P.S. Case No. 44 of 2019.
