The petitioner seeks bail in connection with Special (Excise) Case No. 428 of 2019, arising out of Sour Bazar P.S. Case No. 369 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Section 272 and 273/34 of the Indian Penal Code. The accusation is of recovery of 22 cartons, each containing 48 bottles of 180 ML, 25 cartons, each containing 24 bottles of 375 ML and 30 cartons, each containing 12 bottles of 750 ML Indian made foreign liquor from the straw house of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Saharsa in connection with Special (Excise) Case No. 428 of 2019, arising out of Sour Bazar P.S. Case No. 369 of 2019.
