The petitioner is in custody in connection with Marauna P.S. Case No. 32 of 2016 (G.R. No. 765 of 2016) for the offence under Section 366/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent and he is in custody since 05.09.2018.

From perusal of the statement of victim recorded under Section 164 Cr.P.C. it appears that Babloo has committed rape and there is no allegation against this petitioner. Considering the fact that petitioner has no criminal antecedent and period of custody of the petitioner since 05.09.2018, let the petitioner named above, is directed to be

Patna High Court Cr.Misc. No.77190 of 2018(2) dt.10-01-2019 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Marauna P.S. Case No. 32 of 2016 ( G.R. No. 765 of 2016) with condition that one of the bailor should be elected representative of the local body.
