2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30 (a) , 30 ( d ), 38 and 47 of Bihar Prohibition and Excise Act.

3 . It is alleged that total 140 liters country made liquor and 90 kg mahua flower have been recovered from the spot.

4. It is submitted that the petitioners are innocent and have falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from

Patna High Court CR. MISC. No.635 of 2025(2) dt.06-02-2025 2/2 the conscious possession of these petitioners and they are no way connected with the aforesaid recovery. Petitioners claim clean antecedent.

5 . Learned counsel for the State opposes the bail petition .

6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Exclusive Special Excise Court No. - V - Gaya in connection with Barachatty Police Station Case No. 742 of 2017 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
