JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Pipri Bazar P. S. Case No. 83 of 2019 registered for the offences punishable under Sections 147, 148, 149, 307, 353 of IPC and Section 27 of the Arms Act and Sections 16, 17, 18, 20, 23 and 28 of the U.A.P. Act.

Petitioners are not named in the F.I.R. As per F.I.R. police raided the place of occurrence on the information from the member of Naxalites and there was firing from both sides and several Naxalites papers and other articles were recovered. No. 76850 of 2019 and some of them has already been granted anticipatory bail by a Co-ordinate Bench of this Court as well as by this Court. Further submission is that petitioners are in custody since 06.08.2019. They are ready to abide by any condition imposed upon them and they are ready to co-operate in disposal of the trial. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sub- Divisional Judicial Magistrate, Lakhisarai, in connection with Pipri Bazar P. S. Case No. 83 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that they will not leave the jurisdiction of Civil Court without prior permission of the court below.
