The petitioner seeks bail in connection with Sadar P.S. Case No.711 of 2019 registered under Sections 147, 341, 342, 323, 324, 307, 379, 385, 387 and 506 of the Indian Penal Code. The accusation is that on 14.10.2019, when the informant was returning after offering the 'Puja' at Hanuman Temple, in the way, six persons, named in the F.I.R., including the petitioner variously armed with weapons attacked at him. At that time, the petitioner was armed with knife, whereas Manoj Rai was armed with sword, Anil Rai was armed with iron rod and Shail was armed with Fatta and hockey stick. On receiving the injury, when the informant fell down, then Raja Kumar rushed to save him and he was also

Patna High Court CR. MISC. No.78225 of 2019(2) dt.08-01-2020 2/2 assaulted by them. The cause of occurrence is that, earlier, Manoj Rai had demanded the ransom of Rs.5,00,000/- from the informant through his men and when the informant refused, he was given threatening of dire consequences.

Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. along with others with the allegation to cause injury to the informant and Raja Kumar but their injury is of simple in nature. The petitioner is in custody since 20.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No.711 of 2019.
