The petitioner, being the father of the husband of the vcitim is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the IPC. The prosecution case, as per the written report of Nagina Tanti, dated 24.08.2018, submitted to the Station House Officer, Dharhara Police Station, is to the effect that the daughter of the informant, Sangeeta Devi was married with Deepak Tanti in the year 2016. The husband of the victim was working at Chennai, and the daughter of the informant used to reside with his parents-in-law, whereas the elder brother of the husband of the victim along with his family members used to live separately, as a result, the other brother of the husband of the informant and

It is further alleged that the informant's daughter informed the informant about the torture being inflicted by the accused persons. On 23.08.2018, the informant came to know through some co-villagers that his daughter has been killed. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name subsequently, sprang up during investigation. It is further submitted that no specific accusation has been levelled against the petitioner and the husband of the victim has not been made as an accused in the present case.
Learned APP submits that the name of the petitioner sprang up during investigation.
Considering the fact that specific accusation has been levelled against the FIR named accused persons and the name of the petitioner sprang up during investigation, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-1st, Munger in connection with Dharhara P.S. Case No. 223 of 2018, subject to the
