2. This Court vide order dated 16.07.2024 had directed the officer bearer of the Zila Parishad to settle the claim of the petitioner and pay all admissible dues to him by passing necessary orders.

A counter affidavit is said to have been filed on behalf of the respondent no.4 in which it has been specifically stated that despite this petitioner having retired, the requisite records which were lying with him were not returned and, therefore, for preparing the inventories of files and records, various letters are said to have been issued but that were not responded.

Counsel for the petitioner has taken this Court to the rejoinder filed by the petitioner to the averments made in the counter affidavit and by referring to Annexure-P/6 has submitted that the requisite records which were lying with him have already been forwarded and the necessary receipts are appended with regular communication established with D.D.C., Katihar is also appended to show that the petitioner was in regular touch with the authorities of the Zila Parishad but, for unexplained reason, the necessary orders with regard to the settlement of pension and pensionary benefits have not been passed in favour of the petitioner who is said to have retired on 31.10.2021.

Counsel for the State submits that the entire exercise has to be carried out by the Zila Parishad, Katihar and presently has no role to play in the matter and an appropriate directions may be issued to the authority of the Zila Parishad for taking appropriate action. Counsel for the Zila Parishad has no objection to the submissions made by the State.
6. Considering the submissions of the parties, this Court is of the view that instead keeping this matter pending, the petitioner is directed to submit an appropriate representation giving response to the annexures which have been appended
Patna High Court CWJC No.503 of 2024(3) dt.04-12-2025 3/3 with the counter affidavit by which the petitioner was called in question to return the records and file by preparing inventory which according to them has not been responded as yet.

It is expected that the petitioner shall make appropriate representation within a period of four weeks from today with all supportive materials to justify his stand with regard to return of the records and on satisfaction recorded by the respondent no.4 with regard to receipt of records which is said to be lying with the petitioner, appropriate orders shall be passed deciding the claim of the petitioner within a period of eight weeks and all such benefits for which the petitioner is entitled shall be extended within the said time.
8. With the aforesaid observation and direction, the writ petition stands disposed of.
