In this case, the petitioner is seeking anticipatory bail in connection with Kartahan P.S. Case No.74 of 2018, registered for the offence punishable under Sections 120 (B)/304 (B)/34 of the Indian Penal Code.
The petitioner happens to be brother-in-law of the deceased and allegation against him and others is of causing death of the deceased for non- fulfillment of demand of dowry, however, counsel for the petitioner submits that he has falsely been inplicated in this case and the real fact is that as her husband was working outside and was not taking her with
Patna High Court CR. MISC. No.79093 of 2019(2) dt.11-12-2019 2/2 himself, she committed suicide. Moreover, mother-in-law and father-in-law of the deceased have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 16.11.2019 passed in Cr. Misc. No.48778 of 2019. Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M-XV, Hajipur, Vaishali/court concerned in connection with Kartahan P.S. Case No. 74 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
