JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-01-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 325, 504, 506, 307, 34 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the F.I.R named accused persons variously armed came at the door of the informant and assaulted the informant and other family members. It is alleged against the
Patna High Court CR. MISC. No.1615 of 2024(2) dt.24-01-2024 2/3 petitioner that he assaulted with spade on the head of the informant's wife, resulting in head injuries. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner and informant are agnates and in the background of some petty dispute, the petitioner has been roped in the present case. There is counter version of the occurrence also and petitioner's side also sustained injuries. The petitioner is languishing in custody since 27.08.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
