1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Korha Police Station Case No. 168 of 2025, disclosing offences under Sections 191(2), 190, 126(2), 115(2), 262, 132, 74, 352, 351(2) of the BNS, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act and Section 3 and 4 of the Dowry Prohibition Act.

As per the prosecution case, on 13.07.2025 at about 05:00 A.M., upon receiving information, regarding illegal preparation and sale of country-made liquor by the co-accused Murang Moi at her residence in village Binji, the informant conducted a raid at the said place. During the raid, Murang Moi along with her family members was found present, and 05 liters

It is further alleged that the accused persons and coaccused obstructed the informant in the discharge of official duties, engaged in a scuffle with police personnel and with the help of unknown persons assaulted the raiding party, causing injuries to the informant and other police personnel. The accused Murang Moi was allegedly rescued from police custody, and government vehicles bearing Registration Nos. BR01PB-6825, BR11H-4845, and JH15AB-6780 were damaged.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to village party politics. No specific role or overt act is attributed to the petitioner, and the allegations are general and omnibus in nature. The F.I.R. names only three accused persons along with 10-15 unknown persons. He next submits that the petitioner is not alleged to have assaulted the raiding party. The injuries sustained by the police personnel are simple in nature and no liquor was recovered from the conscious possession of the petitioner. 5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Katihar, in connection with Korha Police Station Case No. 168 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
