The petitioner apprehends his arrest in connection with Saraiya P.S. Case No. 562/2019 registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that only because the petitioner was standing near a hanging bag which was having certain bottles of liquor, the petitioner has been named in connection with the present case. It is further submitted that though the petitioner was neither apprehended on the spot nor anything was found from his possession yet his name has been disclosed in the FIR on the basis of some information received by the police.
Considering aforementioned facts and circumstances
Patna High Court CR. MISC. No.80837 of 2019(2) dt.10-12-2019 2/2 and that the alleged recoveries were not from the conscious possession of the petitioner and that he has no criminal antecedents, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Saraiya P.S. Case No. 562/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
