JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Imamganj P.S. Case No. 96 of 2019, registered under Sections 366(A) of the Indian Penal Code. The accusation is that daughter of informant Virendra Prasad, aged about 16 years, had gone to Sanjay Gandhi College, Imamganj for registration on 17.06.2019, but she did not return till late evening. On search, informant came to know that his daughter has been kidnapped by Nagendra Kumar @ Chhotu with the help of his maternal uncle Ramdas Mahto (Petitioner No.1) and his son Santosh Kumar (Petitioner

Patna High Court CR. MISC. No.81437 of 2019(5) dt.17-06-2020 2/2 No.2) for the purpose of marriage.

Learned counsel for the petitioners submits that, in fact, due to love affairs, the daughter of informant, aged about 19 years, left her house and moved with co-accused Nagendra Kumar @ Chhotu and both are residing at Delhi after performing marriage, the aforesaid facts has come in the statement of the victim recorded under Section 164 of the Cr.P.C. on 24.12.2019.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Imamganj P.S. Case No. 96 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
