Mr.Amitesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-02-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Tatarpur (Vishwa Vidyalaya) P.S. Case No. 112 of 2018, registered for the offence punishable under Sections 392 of the Indian Penal Code.

The allegation is regarding unknown miscreants having intercepted the informant and thereafter, had snatched a sum of Rs. 7600/-.

The learned counsel for the petitioner submits that the name of the petitioner has transpired in the present case upon confessional statement made by one co-accused namely, Md. Jashim. It is submitted that the petitioner has been falsely implicated in the present case though neither any

No.5683 of 2019(2) dt.04-02-2019 2/2 recovery has been made from the house of the petitioner regarding the stolen articles nor any Test Identification Parade has been held to connect the petitioner with the alleged crime. It is submitted that though the petitioner is an accused in one other case, but he is on bail. The petitioner is stated to be languishing in custody since 10.06.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VII, Bhagalpur in connection with Tatarpur (University) P.S. Case No. 112 of 2018.
