====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 103, 76, 352 and 3(5) of the B.N.S., 2023.

3. As per the F.I.R., the informant, namely Sheela Devi, alleged that on 09.08.2025 at about 6 o'clock, all the F.I.R.-named accused persons including these petitioners came, and co-accused Vijay Paswan and Pawan Paswan started threatening the mother-in-law of the informant. The other accused persons pulled her saree and made her naked and thereafter assaulted her with an iron rod. When the informant went to rescue her, she was also assaulted and misbehaved with, and in the alleged occurrence, the mother-in-law of the informant died.

Learned counsel for the petitioner submits that coaccused Shiv Shankar Paswan and others, having similar and identical allegations, have already been granted bail by this Court vide order dated 20.11.2025 passed in Cr. Misc. No. 79250 of 2025. Specific allegation is against co-accused Pawan Paswan and there is a general and omnibus allegation against the petitioner. The petitioner is in custody since 09.10.2025 and the charge-sheet has been submitted in this case.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, S.C./S.T. (POA) Act, Darbhanga, in connection with Fekla P.S. Case No. 78 of 2025.
