JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 Petitioners seek regular bail in connection with Itarhi P. S. Case No. 175 of 2019, registered for the offences punishable under Sections 341, 323, 307, 34 of IPC and Section 27 of the Arms Act.

Allegation as per F.I.R. is of firing against the sons of the petitioners to the informant and there is also allegation in the later part against the petitioners and other of indiscriminate firing.

Submission of the learned counsel for the petitioners is that only one empty cartridge has been recovered. Petitioners are in custody since 27.07.2019. Charge sheet has already been submitted.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Itarhi P. S. Case No. 175 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
