The petitioner is apprehending his arrest in connection with Phulpaas P.S.Cas No.171 of 2018 dated 9.8.2018 , registered for offences punishable under Sections 302, 341, 120(B), 201 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the petitioner and other accused persons killed her daughter and tried to dispose of the dead body and it further appears that earlier the daughter of the petitioner had fled away with another boy and thereafter she was brought to the house. Submission of the learned counsel for the petitioner is that she is mother and except suspicion there is no other allegation against the petitioner and she is ready to abide by any condition imposed upon her.

Patna High Court CR. MISC. No.5667 of 2019(6) dt.07-05-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail . No doubt the petitioner is one of the family members and the allegation is of killing her daughter and trying to dispose of the dead body but considering the fact that the allegation is against all the family members and the petitioner happens to be a lady, as such let the petitioner, above named, surrender before the court below within a period of six weeks from the date of receipt of order and on surrender she will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Jhanjharpur, Madhubani in connection with Phulparas P.S.Case No.171 of 2018 dated 9.8.

2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that she has to cooperate in the investigation and appear before the police as and when required otherwise her bail bond shall be cancelled. With the aforesaid direction, this application is disposed of.
