JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Maker P.S. Case No. 124 of 2018, registered for the offences punishable under Sections 188, 272, 273, 308 of the Indian Penal Code and Sections 30, 30A, 41 and 47 of Bihar Prohibition and Excise Act.
Allegation is of recovery of 40 litres of liquor from the tempo and petitioner happens to be owner of the tempo. Submission of learned counsel for the petitioner is that he has given the tempo to the driver for running the same and he was not aware about the recovery and he has no criminal antecedent.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest
Patna High Court CR. MISC. No.5409 of 2019(3) dt.13-03-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeVI, Saran, in connection with Maker P.S. Case No. 124 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
