JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Obra P.S. Case No. 104 of 2019, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in course of Tilak Samaroh of brother-in-law of cousin sister of the informant, Pankaj Kumar and five persons named in the FIR made firing in the air. On protest made by Mukesh Kumar, brother of the informant, Rajesh Yadav and Mahesh Yadav exhorted to assault him. Thereafter, in the firing of Baban Singh, Mukesh Kumar, brother of the informant, sustained firearm injury at his neck,

Learned counsel for the petitioner submits that it would appear from the FIR that informant has detailed the name of five persons but in supervision note of Dy.S.P., in paragraph 34 of the case diary, only it has come that in the Videography, as taken at the place of occurrence, this petitioner was found in standing condition with the co-accused, except that nothing has been collected by the Investigating Officer showing his involvement in the present case. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in connection with Obra P.S. Case No. 104 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
