2. In the present case, the petitioners seek bail in connection with STR No. 258 of 2022, arising out of Sheikhpura P.S. Case No. 81 of 2009 dated 11.03.2009, registered for the offences punishable under Sections 147, 149, 341, 323, 324 and 307 of the Indian Penal Code.

3. As per the prosecution case, the petitioners and other co-accused persons assaulted the informant and tried to strangulate him.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and they have

Patna High Court CR. MISC. No.85728 of 2025(2) dt.10-12-2025 2/3 falsely been implicated in the present case. No occurrence in the manner as alleged has ever taken place. The petitioners are poor persons and they have been working in other State for earning their livelihood and for this reason they could not appear before the learned trial Court earlier and for this reason the petitioners were declared absconders and permanent warrant was issued against them on 25.07.2024. The petitioners surrendered before learned trial Court on 05.09.2025 and charges have been framed on 24.09.2025. Learned counsel next submits that petitioners have no criminal history and they are in custody since 05.09.2025. Learned counsel lastly submits that the petitioners undertake to appear before the learned trial Court on each and every date till the conclusion of the trial.

Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioners and submits that the petitioners were declared absconders as they failed to appear before the learned trial Court despite issuance of warrant and proclamation against them and thereafter, judgment orders were passed.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of allegation, clean antecedent of the petitioners, their

No.85728 of 2025(2) dt.10-12-2025 3/3 period of custody and framing of charge, the petitioners, abovenamed, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Sheikhpura / concerned Court, in connection with STR No. 258 of 2022, arising out of Sheikhpura P.S. Case No. 81 of 2009, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of non-appearance of the petitioners on single date or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the Court concerned.
