2. The petitioner apprehends arrest in connection with Sandesh P.S. Case No. 298 of 2022 dated 29.12.2022 instituted for the offence punishable under Sections 354(b) of the Indian Penal Code & 8 POCSO Act.

3. The allegation against the petitioner is that on 26.12.2022, he caught the daughter of the informant with bad intention and molested her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the informant is the uncle of the petitioner. Learned counsel for the petitioner submits that the victim is the cousin sister of the petitioner. Learned counsel for the petitioner submits that from perusal of the impugned order,

No.5619 of 2024(2) dt.17-02-2024 2/2 it transpires that the lower court has mentioned that the victim, in her statement recorded under Section 164 of the Cr.P.C., has supported the incident except the molestation and sexual assault. Learned counsel for the petitioner further submits that informant and the petitioner are agnates and there is some family dispute between them. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Sandesh P.S. Case No. 298 of 2022, he will be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI cum Special Judge, POCSO, Bhojpur, Ara, subject to condition as laid down under Section 438(2) of the Cr.P.C.
