The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

By order dated 28.06.2019 bail petition of the petitioner has been rejected on the ground that the petitioner is the main assailant.

It has been submitted on behalf of the petitioner that the sole eye-witness of this case namely Kiran Devi wife of the deceased during trial has not taken the name of the petitioner as a main assailant, therefore, the present bail application has been filed by the petitioner.

Considering the facts and circumstances of the case, I

Patna High Court CR. MISC. No.85731 of 2019(2) dt.22-01-2020 2/2 am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Sessions Trial No. 94 of 2019 arising out of Chanan P.S. Case No. 51 of 2017 pending before the court of the learned Additional District and Sessions Judge-II, Lakhisarai.
