JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 This is an application for grant of anticipatory bail in connection with Bhagwanpur P.S. Case No. 107 of 2018, disclosing offences under Sections 341, 323, 324, 307, 34 of the Indian Penal Code and Sections 27(1-b)a, 26, 27, 34 of the Arms Act.

Allegation as per F.I.R. is that police got an information that some criminal have fired upon one Sushant Kumar and one accused person was arrested by local people and he disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he is the villager of Sushant Kumar and has not been named in the F.I.R. Further submission is that Sushant Kumar in his statement

Patna High Court Cr.Misc. No.2153 of 2019(3) dt.07-02-2019 2/2 has stated that the petitioner is innocent and the petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IIIrd Vaishali at Hajipur, in connection with Bhagwanpur P.S. Case No. 107 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
