Mr.Nawal Kishore Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are seeking anticipatory bail in connection with Suryapura P.S. Case No. 98/2018 registered under Sections 341, 307, 504/34 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate, Vikramganj, Rohtas.

Learned counsel for the petitioners submits that there are general and omnibus allegation and all the injuries have been found to be simple in nature.

Learned A.P.P. for the State has however pointed out that all these petitioners formed unlawful assembly and brutally assaulted the informant and another persons accompanying him.

Having heard learned counsel for the petitioners and learned A.P.P., taking note of the repeated injuries caused on the head of the informant, this court is not willing to extend the benefit of anticipatory bail to the petitioners. The application is dismissed.

In case, the petitioners appear and pray for regular bail in the court below within two weeks from today, their prayer for bail shall be considered on its own merit on the basis of the materials available on the record without being prejudiced by the order of this court.
