====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 30-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Kopa P.S. Case No. 93 of 2021 dated 23.05.2021 registered for the offence punishable under Section 392 of the I.P.C.

3. As per the prosecution case, while the informant alongwith his brother were returning to home from attending the ceremony, in the meantime, four unknown persons surrounded them and snatched their motorcycle on the point of pistol.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is not named in the F.I.R. His name has surfaced in the present case on the basis of

Parade has been conducted to ascertain the accusation of the petitioner in the present case. No incriminating article has been recovered from his possession. The petitioner is a student of B.Sc.

having Registration No.

JPU/20222023/CNLSC/UG/00140 for the Sessions 2022-2025 and he is pursuing his study with Botany, Chemistry and Hindi from Jai Prakash University, Chapra. It is further submitted that the other co-accused person, namely, Raman Singh @ Ranvir Singh has already been granted bail by the Co-ordinate Bench of this Court vide Cr. Misc. No. 69770 of 2022 under order dated 28.02.2023, annexed as Annexure-4 to the present bail application. The petitioner has three criminal antecedents in which he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 08.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional
