The petitioner is accused in connection with Saraiya P.S. Case No. 639 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that in course of patrolling duty, two persons were seen on motorcycle by the informant and other police personnel. On seeing the police party, both started to flee away but on chased, both were apprehended, who disclosed their names as, Ujjawal Kumar and Arjun Singh (petitioner). On search of motorcycle, 25 bottles each containing 180 ml Indian made foreign liquor were recovered. On query,

Patna High Court CR. MISC. No.81302 of 2019(2) dt.18-12-2019 2/2 both apprehended persons disclosed that Arjun Kumar (petitioner) and Suman Singh also used to do the business of illicit liquor.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 25.10.2019. Moreover, the petitioner has no concerned with the seized liquor nor he is the owner of the seized motorcycle. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur, in connection with Saraiya P.S.
