JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This is an application for grant of anticipatory bail in connection with Guthni P.S. Case No. 90 of 2018, disclosing offences under Sections 147, 341, 323, 324, 308, 379 and 504 of the Indian Penal Code.
Allegation against the petitioner no.2 is of assault by farsa on the head of the informant and there is also allegation of assault against other accused persons.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and all the injuries are found to be simple in nature, except one injury i.e. attributed to petitioner no.2 about which opinion was kept

Having heard both sides, considering the above submission, so far petitioner no.2 is concerned, I am not inclined to grant anticipatory bail to him, rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record specially the injury report.
So far petitioner nos.1, 3, 4, 5, 6 and 7 are concerned, this application is allowed. Let petitioner nos.1, 3, 4, 5, 6 and 7, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Guthni P.S. Case No. 90 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) Amjad/- U T
