====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Parsa P.S. Case No. 198 of 2018, instituted for the offence under Sections 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act.
In the written report it is alleged that five persons were apprehended by the police. It is further alleged that police recovered firearm from possession of two persons namely, Munna Miyan and Sachin Rai as mentioned in the written report. There is no recovery of any incriminating article from possession of the petitioner.
Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. He is in custody since
Patna High Court Cr.Misc. No.77585 of 2018(2) dt.15-01-2019 2/2 30.9.2018. Counsel for the petitioner further submits that coaccused Sarfaraj Alam has been granted bail by this Court vide order dated 17.12.2018 passed in Cr. Misc. 75469 of 2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Parsa P.S. Case No. 198 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
