====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 15-06-2020 Heard learned counsel for the petitioner.

The petitioner is seeking relief of issuance of mandamus commanding and directing the respondents to grant benefit of compassionate appointment on account of death of her husband, who was working as class IV employee and died on 30.05.2017.

From the record, it appears that an FIR was lodged by the petitioner that her husband has been killed by some unknown criminals, but during investigation, the police has found her to be involved in killing of her husband and she was sent to the judicial custody and from where she has been granted bail vide order dated 04.05.2018 passed in Cr. Misc. No.18254 of 2018.

Patna High Court CWJC No.24579 of 2018(4) dt.15-06-2020 2/2 As the petitioner is involved in the criminal case of committing murder of her husband, this Court is not inclined to issue any direction or mandamus giving any relief to the petitioner.

In such view of the matter, this petition has no merit and, accordingly, the same is dismissed.

However, if the petitioner gets an acquittal from the court below, in such circumstances, she will be at liberty to renew her prayer.
