Mr.Nityanand, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Parbatta P.S. Case No.113 of 2019 registered for offence punishable under Sections 380 and 411 of the Indian Penal Code.

Allegation has been made that three persons have entered into the house of the informant with an intention to commit theft. The co-accused Ajeet Kumar was apprehended and two persons with cash of Rs. 35,000/-, jewelries and other articles managed to escape away.

Counsel for the petitioner submits that the aforesaid apprehended co-accused Ajeet Kumar has named the petitioner in his confessional statement. Nothing has been recovered from the possession of the petitioner. The co-accused Ajeet Kumar has already been granted bail by this Court vide order dated

Patna High Court CR. MISC. No.78964 of 2019(2) dt.04-12-2019 2/2 24.07.2019 passed in Cr. Misc. No.44954 of 2019. It is urged that the petitioner is in custody since 4.08.2019 having no criminal antecedent.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1, Khagaria in connection with Parbatta P.S. Case No.113 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
