2. The petitioner is apprehending his/her arrest in connection with Imamganj P.S. Case No. 220 of 2025, dated 16.07.2025 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per the prosecution case, on 16-07-2025, after receiving confidential information, the police force raided the house of accused/ petitioner namely Soni Devi and seized 03 litres of illicit sterling reserve whiskey, kept in a plastic bag and 05 litres of illicit country made mahua liquor, kept in a plastic polythene was recovered from the house of accused/petitioner Soni Devi and present F.I.R. was lodged against the accused/

Learned counsel for the petitioner submits that the recovery is shown to have been made from the house of the petitioner, while the said house is in joint possession and averment to that effect has also been made in paragraph- 10 of the bail application. It has next been submitted that the petitioner is a house wife and having two small children to look after and for ulterior reason the petitioner has been roped in this case. The petitioner is no way connected with the seized articles. It has fairly been submitted that petitioner has one criminal antecedent, in which she is on bail.

5. Learned APP for the State opposes the prayer for anticipatory bail application.

6. Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the constructive possession and/or premises belonging to the petitioner and accordingly, this Court is inclined to grant anticipatory bail to the petitioner.

7. Considering the aforesaid, let the petitioner, above named, be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/-

No.87707 of 2025(2) dt.19-12-2025 3/3 (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-2, Gaya in connection with Imamganj P.S. Case No. 220 of 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S.
